Unopposed Divorce -- No Children

Terms and Conditions

Before you complete the form please read through and agree to the terms and conditions:
  1. Eligibility

The All-Inclusive Unopposed Divorce Package is available only to couples who have already reached agreement on all material terms of their divorce and intend to proceed with the divorce on an unopposed basis.

  2. Initial Consultation

The package includes one 30-minute consultation. The purpose of the consultation is for the attorney to explain the unopposed divorce process and provide a brief overview of the legal implications of the settlement reached by the parties. The consultation is not a mediation or negotiation session and does not include negotiating the terms of the settlement.

  3. Independent Legal Advice

The parties acknowledge that C&A Friedlander Attorneys has a limited mandate to facilitate and finalise the divorce on the agreed terms and cannot provide independent legal advice to both parties regarding their respective interests. Either party who requires advice regarding the fairness, consequences or suitability of the agreed settlement should obtain independent legal advice before signing the settlement agreement.

  4. Our Mandate

C&A Friedlander Attorneys' mandate is limited to recording the parties' agreed terms in a settlement agreement and, where applicable, parenting plan; preparing the documents required to institute the divorce proceedings; attending to the procedural steps necessary for an unopposed divorce; and finalising the divorce on an unopposed basis.

  5. Full Disclosure

The parties are required to make full, frank and proper disclosure to one another of all information relevant to the divorce and settlement, including their assets, liabilities, income and other relevant financial information. C&A Friedlander Attorneys is entitled to rely on the information and documentation provided by the parties and cannot be held liable for any non-disclosure by either of the parties.

  6. Communication with the Firm

All communications with C&A Friedlander Attorneys concerning the divorce must include both parties. If either party communicates with the firm without copying the other party, the communication may be forwarded to the other party. The parties should therefore have no expectation that communications concerning the divorce will be confidential as between them.

  7. Disagreement or Negotiations

The package does not include mediation, negotiation or the resolution of disputes between the parties. If a disagreement arises regarding the terms of the settlement, or further negotiations are required, that work falls outside the scope of the package.

  8. Additional Work and Fees

Any legal advice, negotiations, additional consultations, substantial amendments to documents, or other work requested or required outside the scope of the package will be charged separately at the applicable hourly rate of the attorney or staff member performing the work. These fees are payable in addition to the package fee.

  9. If the Divorce Becomes Opposed

If the divorce becomes opposed or contentious, or negotiations between the parties break down, the matter will no longer qualify for the All-Inclusive Unopposed Divorce Package. Due to the nature of the firm's mandate, C&A Friedlander Attorneys will withdraw from the matter and will not represent either party in the resulting dispute or opposed divorce proceedings. Each party will then be required to obtain independent legal representation.

  10. Counsel's Appearance Included

The package fee includes the cost of counsel instructed by C&A Friedlander Attorneys to appear at the hearing of the unopposed divorce, where counsel's appearance is required.

  11. Sheriff's Fees and Other Disbursements

The package fee does not include the Sheriff's fees for service of process. These fees will be recovered separately from the client/s. Unless expressly stated otherwise in the quotation, any exceptional third-party disbursements or expenses falling outside the ordinary scope of the package will also be payable separately.

  12. Client Onboarding and FICA

Before the consultation is scheduled or any documents are drafted, the parties must complete the firm's required client onboarding documentation, provide all documents and information required for FICA and other compliance purposes, and pay the required deposit.

  13. Payment Terms

A deposit equal to 50% of the package fee is payable before the consultation will be scheduled and drafting will commence. The remaining 50% must be paid in full before the divorce is set down for hearing.

  14. Co-operation by Both Parties

The package is based on both parties co-operating fully and timeously with the process, including providing requested information and documentation, reviewing and signing documents, and complying with procedural requirements. Material delays or additional work caused by a party's failure to co-operate may fall outside the scope of the package and may result in additional fees.

  15. Court and Third-Party Processes

C&A Friedlander Attorneys cannot guarantee the date on which the divorce will be heard or finalised. Court availability, Sheriff's service, Family Advocate processes (where applicable), and other third-party or administrative processes are outside the firm's control.

  16. Court Approval

The parties acknowledge that the granting of the divorce and the incorporation of any settlement agreement and/or parenting plan into the divorce order remain subject to the requirements and approval of the Court. Where minor children are involved, additional requirements or recommendations of the Office of the Family Advocate may apply.

  17. Scope of the Package

The package applies only for so long as the matter remains an unopposed divorce, capable of being dealt with within the ordinary scope of this service. Any services falling outside that scope will be discussed with the parties and, where applicable, charged separately.
